{"id":13603,"date":"2015-05-18T11:08:41","date_gmt":"2015-05-18T11:08:41","guid":{"rendered":"https:\/\/cityadventurers.co.uk\/blog\/?p=1652"},"modified":"2015-05-18T11:08:41","modified_gmt":"2015-05-18T11:08:41","slug":"human-rights-act-to-be-scrapped","status":"publish","type":"post","link":"https:\/\/cityadventurers.co.uk\/blog\/?p=13603","title":{"rendered":"Human Rights Act to be scrapped"},"content":{"rendered":"<p>Historic turning point in Human Rights<\/p>\n<p class=\"title\">In <a title=\"http:\/\/www.humanrights.com\/what-are-human-rights\/brief-history\/magna-carta.html\" href=\"http:\/\/www.humanrights.com\/what-are-human-rights\/brief-history\/magna-carta.html\" target=\"_blank\" rel=\"noopener noreferrer\">&#8220;A Brief History of Human Rights&#8221;<\/a> The Magna Carta is described as &#8220;arguably the most significant early influence on the extensive historical process that led to the rule of constitutional law today in the English-speaking world.\u00a0In 1215, after King John of England violated a number of ancient laws and customs by which England had been governed, his subjects forced him to sign the Magna Carta, which enumerates what later came to be<strong> thought of as human rights<\/strong>.&#8221;<\/p>\n<p>As we celebrate the 800th anniversary of Magna Carta it is ironic that changes are afoot to change, some would say remove, our human rights&#8230;&#8230;<\/p>\n<h2>Remove\u00a0the rights we, in Britain, take for granted.<\/h2>\n<p>Winston Churchill wanted to safeguard human rights after the World War Two and the\u00a0<a class=\"story-body__link-external\" href=\"http:\/\/www.echr.coe.int\/Documents\/Convention_ENG.pdf\">European Convention on Human Rights<\/a>\u00a0came from his desire to\u00a0<a title=\"bbc\" href=\"http:\/\/www.bbc.co.uk\/news\/uk-32733609\" target=\"_blank\" rel=\"noopener noreferrer\">enthrone human rights<\/a>. It was drafted by British lawyers.<\/p>\n<h3>However, todays Conservative party has other ideas.<\/h3>\n<p class=\"title\"><span style=\"color:#ff0000;\"><a class=\"story-body__link-external\" style=\"color:#ff0000;\" title=\"manifesto\" href=\"https:\/\/www.conservatives.com\/europe\/~\/media\/Files\/Downloadable%20Files\/MANIFESTO%202014\/Large%20Print%20Euro%20Manifesto_English.ashx\" target=\"_blank\" rel=\"noopener noreferrer\">The Conservative Party&#8217;s 2015 manifesto <\/a>states: &#8220;The next Conservative government will scrap the Human Rights Act, and introduce a British Bill of Rights. This will break the formal link between British courts and the European Court of Human Rights and make our own Supreme Court the ultimate arbiter of human rights matters in the UK.&#8221;<\/span><\/p>\n<p class=\"title\">The Conservative Government won the election, although\u00a0only 25 % of the electorate voted for them and so, they believe they have the \u00a0mandate to remove the fundamental rights\u00a0of protection.<\/p>\n<h3 class=\"title\">Not everyone agrees.<\/h3>\n<p>There are calls that such an important change to our rights and our freedoms, requires the\u00a0matter to be decided by the people in a national referendum. Petitions are gaining ground, such as <a title=\"human rights petition\" href=\"https:\/\/www.change.org\/p\/david-cameron-mp-we-call-on-the-government-and-the-prime-minister-to-provide-a-national-referendum-on-the-planned-abolition-of-the-human-rights-act?utm_source=auto_update&amp;utm_campaign=verified_tweet&amp;utm_medium=email&amp;tk=jWnmNolR32F2dqP6U_aaE121MQOWp9qPqMtKaorXnek\" target=\"_blank\" rel=\"noopener noreferrer\">&#8220;We call on the Government and the Prime Minister to provide a national referendum on the planned abolition of the Human Rights Act.&#8221;<\/a><\/p>\n<p>Amnesty internationals have a similar petition, pointing out that &#8220;<a title=\"human rights\" href=\"http:\/\/keeptheact.uk\/#signup-form\" target=\"_blank\" rel=\"noopener noreferrer\">Every single one of us is protected by the Human Rights Act \u2013 but right now, it\u2019s in serious danger. Don\u2019t let universal freedoms turn into privileges for a chosen few.&#8221;<\/a>\u00a0and 38 Degrees petition urges <a title=\"human rights\" href=\"https:\/\/you.38degrees.org.uk\/petitions\/save-our-human-rights?bucket=blast2&amp;source=facebook-share-button&amp;time=1431500987\" target=\"_blank\" rel=\"noopener noreferrer\">&#8220;Save our Human Rights&#8221;<\/a><\/p>\n<p class=\"title\">There are also some Facebook groups <a title=\"human rights\" href=\"https:\/\/www.facebook.com\/pages\/The-Human-Rights-Act\/114377565303782?fref=ts\" target=\"_blank\" rel=\"noopener noreferrer\">\u201cThe Human rights Act\u201d<\/a> and <a title=\"human rights\" href=\"https:\/\/www.facebook.com\/pages\/Save-the-Human-Rights-Act\/158968787516932?fref=ts\" target=\"_blank\" rel=\"noopener noreferrer\">\u201cSAVE the HUMAN RIGHTS ACT\u201d<\/a> joining the\u00a0fight for a debate on the issue.<\/p>\n<p>&nbsp;<\/p>\n<h2>What do\u00a0politician&#8217;s think?<\/h2>\n<p class=\"story-body__introduction\">First Minister <a title=\"bbc\" href=\"http:\/\/www.bbc.co.uk\/news\/election-2015-wales-32710689\" target=\"_blank\" rel=\"noopener noreferrer\">Carwyn Jones <\/a>warned that scrapping the Human Rights Act would &#8220;make us look like a banana republic&#8221;, .<\/p>\n<p class=\"story-body__introduction\">While David Mundell, the new Scottish secretary, told <a title=\"bbc\" href=\"http:\/\/www.bbc.co.uk\/news\/election-2015-scotland-32705811\" target=\"_blank\" rel=\"noopener noreferrer\">BBC Scotland <\/a>that the UK government&#8217;s plans to scrap the Human Rights Act would apply to Scotland,\u00a0the Scottish government said it would &#8220;robustly oppose&#8221; withdrawal from the European Convention on Human Rights (ECHR). The <a class=\"story-body__link-external\" href=\"http:\/\/www.legislation.gov.uk\/ukpga\/1998\/46\/section\/57\" target=\"_blank\" rel=\"noopener noreferrer\">Scotland Act (1998)<\/a> states all legislation passed by Holyrood must be compatible with the ECHR.<\/p>\n<p>Irish Foreign Affairs Minister Charlie Flanagan said the protection of human rights was a key principle underpinning the 1998 peace agreement and the <a title=\"bbc\" href=\"http:\/\/www.bbc.co.uk\/news\/uk-northern-ireland-32734062\" target=\"_blank\" rel=\"noopener noreferrer\">Irish Government\u00a0<\/a>said it was\u00a0determined to safeguard the Good Friday Agreement.<\/p>\n<p>Former Attorney General <a title=\"bbc\" href=\"http:\/\/www.belfasttelegraph.co.uk\/news\/politics\/dominic-grieve-warns-conservatives-over-human-rights-act-31229875.html\" target=\"_blank\" rel=\"noopener noreferrer\">Dominic Grieve <\/a>has questioned what the Conservative Party is trying to achieve through its plan to replace the Human Rights Act with a new British Bill of Rights.
